Churchtown Farm terms and conditions

These terms and conditions form the basis on which you can visit and use this website or place a flower order by any other means. Before placing an order or registering your details if you have any questions about any aspect of our business or the service we provide please call us on 01720 422169. We are normally open between 8am – 6pm (Mon – Fri) 9am – 5pm (weekends) or contact us using the details on the home page of this website.

What is included in the price

All prices stated include delivery by Royal Mail 1st class post to any UK address and all packaging material – there are no hidden extra costs.

A guarantee of satisfaction - if you have reasonable cause for dissatisfaction with any of our products just notify us (preferably within 10 days of the flowers being received) and we will be more than happy to either replace the flowers or refund your money.

Flowers

To prolong vase life all or some flowers will be sent in bud.

If for any reason we are unable to supply the flowers or foliage you have requested we reserve the right to supply flowers or foliage of an equal or greater value without notice.

The pictures on this website and our publicity material are representative of the flowers and foliage we supply. The exact varieties and colour selection supplied will vary depending on the growing season. We also reserve the right to change or amend any of our packaging materials without notice.

We change the contents of our mixed bouquets quite regularly so that flowers and foliage selected reflect what is seasonally available therefore the contents may vary considerably from those shown in any of our photographs. Please call us if you would like more information.

At Churchtown Farm we grow scented narcissi and scented pinks. Other flowers and foliage that we send will be sourced from other growers.

Where flowers are shown displayed in a vase the vase is not included in the price quoted.

At times of the year when demand for our flowers outstrips Churchtown Farm’s production we reserve the right to source flowers of the same high quality from firstly other Scillonian growers and then from growers elsewhere.

Some of the flowers and foliage we supply may be harmful or poisonous. Please contact us if you require more information.

All flower packs and contents are subject to availability. In the highly unlikely event of us not being able to supply any flowers subsequent to accepting an order, we will endeavor to send a replacement gift, such as a voucher for flowers, of the same or greater value as the original order or we will notify you as soon as is reasonably possible and reimburse any payment made in full not later than 30 days after the intended delivery date.

Ordering

By placing an order with us you are consenting to be bound by these terms and conditions.

Once you have placed an order it can be cancelled or amended up to the point that the message and packing label has been printed, this is normally on the day of dispatch but at busy times such as Christmas and Mother's Day may be up to 7 days before the flowers are packed. If you wish to amend or cancel an order please contact us as soon as possible.

If your order is placed via this web site we will send you an email confirmation to the address you supplied at registration.

For written orders that have been posted to us we endeavour to meet selected delivery dates (please see delivery below). If you send a written order to us by Royal Mail and the delivery of the written order is delayed in the post so that the chosen delivery date has passed or is not possible we will send the flowers to arrive as close to the chosen date as possible. When such delays occur we can’t be held liable for late delivery.

Delivery

Delivery using the Royal Mail’s 1st class postal service is included in the price quoted.

As our flowers are delivered by Royal Mail 1st class post we can’t guarantee a specific time or date of delivery. Most flowers arrive the next day but we can’t guarantee this. Because of this we allow 2 days for delivery.

Because of the above it is not possible for us to guarantee delivery by a Tuesday. Flowers for Tuesday delivery will be sent on Monday to be delivered on Tuesday or Wednesday.

Flowers are sent from the farm on Monday, Tuesday, Wednesday and Thursday. We don’t send on Friday or Saturday as we want your flowers to arrive in the best condition and not be held up over the weekend.

As the Royal Mail don’t collect or deliver on a Sunday or bank holidays we can’t deliver on Mondays or send and deliver on Sundays and bank holidays.

We must receive your order by 12 noon for your flowers to be dispatched the same day Monday to Thursday.

If the Royal Mail fail to deliver the flowers within 2 days of them being dispatched or if they damage the flowers in any way please contact us and we will be happy to replace the flowers or refund your money.

All our flowers boxes are marked ‘fresh flowers please leave’ but this is just a request that the Royal Mail are not obliged to carry out. On the rare occasions the flowers are not left and returned to the sorting office and a failed delivery card is left we will not guarantee flowers that are not collected within 24 hrs.

Orders taken for Christmas will arrive in the 10 days before Christmas. Due to the large amount of post sent at that time of year we are unable to be more specific. For more detail see the December page of our calendar in the ordering process.

We are unable to deliver to PO boxes or BFPO addresses.

Delivery addresses

It is your responsibility to supply us with the correct postal delivery address. If flowers are not delivered on time due to you supplying an incorrect address we reserve the right not to guarantee the flowers. We are more than willing to help you find addresses and postcodes so please contact us if you require help.

Payment 

We reserve the right not to send the flowers you have ordered until we have received full payment. It is your responsibility to make sure you have supplied us with correct personal and payment details to enable us to settle your account. We accept no liability if delivery is delayed because you did not give us the correct payment details. This does not affect your statutory rights.

We will accept payment by most major credit and debit cards excluding Diners Club and American Express. Payment will be taken at the time of ordering.

All credit/debit card payments are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

We don’t automatically issue receipts. If you require a receipt please contact us.

Guarantee

Churchtown Farm is committed to providing you with the best possible postal flower service. If you are not satisfied in any way with the service you have received please let us know as soon as possible preferably within 10 days of when the flowers were due to be delivered. Our contact details can be found on the home page of our web site.

If you have reasonable grounds for dissatisfaction we will be more than happy to replace your flowers or refund. This does not affect your statutory rights.

Returns

Due the perishable nature of flowers, we are unable to accept returns. All of our flowers are fully guaranteed and we offer customers replacement flowers, credit or a refund if the flowers are not delivered to an acceptable quality, as detailed above.

Vouchers and gift cards

Vouchers may only be redeemed for flowers supplied by Churchtown Farm to the value represented by the voucher code. No monetary value can be placed on such vouchers once they have been issued.

Customer Privacy and Security

Churchtown Farm takes protecting the privacy of customers' personal information very seriously. We shall ensure that we comply with the requirements of all current data protection legislation including the General Data Protection Regulation (GDPR) of 2018 and the Data Protection Act 1998 to make sure correct procedures regarding the storage, use and disclosure of your personal information are followed.

Churchtown Farm will never release your details to any third parties for marketing purposes.

Churchtown Farm will periodically send details of our products and any special offers to existing customers using various media. If you would prefer not to receive these details please contact us using the details found on the home page of this website. Please remember to include your name, postal address and if relevant email and we will happily remove you from all future contacts.

We will only contact you via the telephone if there is a query with a specific order.

For all our transactions we employ the most current internet security methods and technologies to ensure your details are totally secure. While we strive to protect your personal information, no system can be 100% guaranteed. We cannot ensure or warrant the security of any information that you transmit to us.

Ownership of rights

All rights, including copyright, in this website are owned by or licensed to Churchtown Farm. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

Limitation of liability

We will make all reasonable endeavours to ensure that this website and our office for taking all other forms of orders are fully operational and error-free, we cannot guarantee that this will always be the case. We therefore accept no responsibility or liability for any defects or interruption of our service.

We shall be released from our obligations under these Terms and Conditions in light of any event beyond our reasonable control, (i.e.: acts of god, civil commotion, riot, flood, fire, drought, severe weather, industrial action) which renders the provision of Churchtown Farm’s services impossible or impractical.

If any aspect of our service fails Churchtown Farm shall only be liable for the original cost of the flowers that were ordered and no other subsequent or resulting losses of any kind that occur.

Any disclaimers and exclusions of liability in these terms and conditions shall not apply to any damages arising from death or personal injury caused by our negligence. These disclaimers and exclusions shall be governed by and construed in accordance with English law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

General

We reserve the right to supplement and amend the Terms and Conditions. It is your responsibility to review the Terms and Conditions on each occasion you access this site. Changes will be effective 24 hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.

We reserve the right to suspend, restrict or terminate access to this site and/or Churchtown Farm’s services for any reason at any time.

Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. To the extent permitted by applicable law we shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.

Damage to your computer

We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
